If I were Judge Kapnick, I would make sure I did not listen to Channel 100 on the satellite radio on Monday...It is a very, very interesting legal issue, and both sides did a very poor job of drafting the agreement. We are talking hundreds of millions of dollars at stake here, people. Maybe you try a little harder to define exactly what happens if you force XM to merge and acquire 9 million more subscribers.
